Terms of Service

1. Agreement to Terms

By accessing or using the BRX Recruiting platform ("Service"), operated by BRX Performance LLC ("Company," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you must have the permission and supervision of a parent or legal guardian who agrees to these Terms on your behalf. By using the Service on behalf of a minor, the parent or guardian accepts full responsibility for the minor's use.

3. Account Registration

To use the Service, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.

4. Description of Service

BRX Recruiting is a college baseball recruiting assessment and school-matching tool. The Service helps athletes and families evaluate college programs, track athletic metrics, manage school outreach, and receive AI-powered recruiting guidance. BRX Performance staff use the Service during Recruiting Assessment Meetings to support athlete families.

The Service does not guarantee admission, athletic scholarships, recruitment outcomes, or placement at any college or university.

5. AI Recruiting Coach

The Service includes an AI-powered recruiting coach ("Coach BRX") that provides general recruiting guidance. Coach BRX is powered by third-party AI technology and its responses are informational only. They do not constitute professional advice, and you should not rely solely on AI-generated guidance for recruiting decisions. BRX Performance is not responsible for the accuracy or completeness of AI-generated content.

6. Email Outreach & Gmail Integration

The Service provides tools to help you compose and send emails to college coaches. You may optionally connect your Gmail account to enable the following features:

  • Send emails to college coaches directly from the app, using your own Gmail account (emails appear in your Gmail Sent folder)
  • Receive replies from coaches in an in-app inbox, limited to email threads you initiated through the Service
  • Track engagement such as whether a coach opened your email, to help you prioritize follow-up outreach

Your Gmail authorization tokens are encrypted and stored securely. We only access emails within threads you initiated through the app — we do not scan, search, modify, or delete any other emails in your account. You can disconnect Gmail at any time. See our Privacy Policy for full details on data handling.

If you choose not to connect Gmail, you may still compose emails using standard Gmail compose links (the email opens in your Gmail in a new tab).

You are solely responsible for the content, legality, and appropriateness of any communications you send using the Service.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Send spam, unsolicited communications, or harassing messages
  • Impersonate any person or entity
  • Attempt to gain unauthorized access to the Service or other accounts
  • Interfere with or disrupt the Service, servers, or connected networks
  • Distribute malware, viruses, or harmful code
  • Scrape, crawl, or harvest data from the Service without authorization

8. Content & Ownership

You retain all rights to the content you create or upload to the Service, including your athletic profile, metrics, preferences, and notes. We store and process your content solely to provide and improve the Service.

The Service, including its design, features, and underlying technology, is owned by BRX Performance LLC and protected by applicable intellectual property laws.

9. Staff Access

By using the Service as an athlete, you acknowledge that authorized BRX Performance staff may access your profile, metrics, school list, and chat history to provide recruiting assessment services. Staff access is limited to personnel directly involved in your recruiting support.

10. Account Termination

You may request deletion of your account at any time by contacting us. We reserve the right to suspend or terminate accounts that violate these Terms. Upon account deletion, your personal data will be removed in accordance with our Privacy Policy.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRX PERFORMANCE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE PRECEDING 12 MONTHS OR $50.

13. Indemnification

You agree to indemnify and hold harmless BRX Performance LLC, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Wisconsin, unless otherwise required by applicable law.

15. Changes to Terms

We may update these Terms at any time. If we make material changes, we will notify you via email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
